South Dakota Division of Criminal Investigation and Attorney General Marty Jackley released a summary of the Officer involved shooting near Beresford South Dakota at Mile Marker 45 on Interstate 29 from September 16th, 2018.
The investigation concluded that the "Trooper was justified in firing their weapon and using lethal force." The summary of the event states that the suspect 21-year-old Kuong Gatluak in addition to the initial reason by Vermillion Police for the traffic stop at 9:25 pm, a welfare check after Gatluak made statements to harm himself, which Gatluak fled Vermillion officers at a high rate of speed in a Toyota Camry.
About 9:30 pm, 5 minutes after the pursuit ended Gatluak arrived at the Coffee Cup where video surveillance shows Gatluak carrying a six-pack of Bud Light and taking several cigar packages from the Tobacco stand. The video does not show him paying for the items before leaving the store.
Exterior video shows him get in his vehicle and an employee approaching, Gatluak then quickly reversed the vehicle nearly striking the employee before speeding away towards Interstate 29.
A trooper spotted Gatluak heading North on Interstate 29 about 9:47 pm and attempted a traffic stop. Gatluak fled at a high rate of speed until pulling over near Mile Marker 45. Gatluak ignored multiple commands to stay in and get back into his vehicle before eventually coming at the Trooper throwing a beer bottle at the Troopers head and tackling the trooper to the ground.
During the struggle on the ground with Gatluak on top, he made attempts to take the Troopers service weapon. Two shots were fired from the Troopers gun sticking Gatluak in the left shoulder and bicep. The investigation concluded the shooting was justified.
